Royalty-Free License Terms

I. License

The royalty-free license does not expire, but is limited to the purchasing individual or company or organization. The license may not be transferred or resold to another individual, company or organization.

The royalty-free license is limited to 10,000 units of each product application or advertisement and any of its derivative works (including but not limited to any publication, advertisement, brochure, CD-ROM graphic, DVD cover, etc). Distribution of a product or publication of more than 10,000 units that contains a Storm Highway image requires an individual product use license from Appalachian Skies Media.

When Storm Highway photos are used in over-the-air, satellite or cable television programming or advertising, the royalty-free license is limited to a local or regional broadcast of 200 miles from the origin point, including any of the production's derivative works. Broadcast or showing of programming or advertising that contains a Storm Highway image outside of a 200-mile radius from the origin point, including but not limited to any national or international television broadcast or cinema and any of the original production's derivative works, requires a national broadcast, worldwide broadcast or theatrical license from Appalachian Skies Media.

Posting of any Storm Highway image or images on any internet medium including but not limited to file sharing services, web sites, message boards, newsgroups, forums, emails or any other freely accessable internet server is prohibited, unless the photo comprises equal or less than 75% of a finished graphic, logo or web site design in which the image(s) are incorporated. In essence, the royalty-free license does not include making our photos available for free download or redistribution on the internet.

The royalty-free license does not include making our photos available for rebranding or redistribution as stock imagery or clip art on the internet or any other digital or non-digital media.

The royalty-free license does not include producing photographic prints of our photos for sale, public display, commercial display, rebranding or redistribution.

The royalty-free license allows for one (1) copy of the CD-ROM discs to be made for backup purposes only. The copies of the discs may not be resold, shared or otherwise made available for use by any party other than the primary license holder.
